1. Platform Purpose & Scope

WhoCalled is a professional crowd-sourced telemetry analysis platform designed to track, identify, and document commercial spam calls, robocalls, telemarketing campaigns, and fraudulent phone-based schemes. The platform operates as an objective information exchange and does not function as a consumer reporting agency under any jurisdiction's regulations.

2. Acceptable Use Policy

All users accessing the WhoCalled platform must adhere to strict professional standards. The following activities are explicitly authorized:

• Searching phone numbers to identify potential spam or fraud patterns
• Submitting objective, factual observations about commercial calling campaigns
• Reporting verifiable robocall or telemarketing violations
• Participating in community-driven data accuracy improvements

The following activities are strictly prohibited and constitute breach of these Terms:

• Profanity & Vulgar Language: Any use of swear words, obscene expressions, vulgar language, or profanity in comments, reports, or any user-submitted content is strictly forbidden.
• Abusive or Harassing Content: Personal attacks, name-calling, threatening behavior, cyberstalking, or targeted harassment of any individual, business, or entity.
• Hate Speech & Discriminatory Language: Content promoting violence, discrimination, or hostility based on race, ethnicity, religion, gender, sexual orientation, disability, age, or national origin.
• Personal Identifiable Information (PII): Submitting personal names, home addresses, email addresses, social security numbers, financial data, or any private individual identifiers.
• False & Malicious Assertions: Knowingly submitting false information, unverified allegations, coordinated misinformation campaigns, or defamatory statements.
• Automated Abuse: Web scraping, bot-based submissions, script-driven lookups, API abuse, or any automated access designed to degrade platform performance.
• Trolling & Provocation: Deliberately posting inflammatory, off-topic, or antagonistic content with the intent to disrupt platform operations or provoke emotional responses.
• Commercial Exploitation: Using platform data for competitive intelligence, lead generation, marketing campaigns, or any commercial purpose without explicit written authorization.

3. Content Moderation & Enforcement

WhoCalled maintains full administrative authority over all platform content. Our moderation systems—both automated and human-reviewed—constantly audit submissions to ensure compliance with these Terms.

Violations trigger immediate enforcement actions including but not limited to:

• Automatic or manual removal of violating content (comments, reports, or submissions)
• Temporary or permanent suspension of submitting privileges
• IP-based access restrictions or permanent bans
• Notification to relevant law enforcement authorities for severe violations (threats, illegal content, fraud schemes)

We reserve the absolute right to modify, mask, archive, or permanently purge any comment, report, or database record that conflicts with our content standards—with or without prior notification to the submitting user.

4. User Accountability & Legal Compliance

You retain full legal responsibility for all content you submit to the WhoCalled platform. By submitting content, you affirm that:

• You own or have obtained all necessary rights to the submitted information
• The content is accurate, factual, and based on firsthand knowledge
• The content does not violate any applicable laws, regulations, or third-party rights
• You will indemnify and hold harmless WhoCalled, its operators, and affiliates against any claims arising from your submissions

5. Data Processing & Infrastructure

This platform infrastructure operates from systems physically located within Greece and adheres to applicable European Union data protection regulations including GDPR (General Data Protection Regulation). Users accessing the platform from external jurisdictions acknowledge that their public text content must comply with relevant international data transfer rules and local content regulations.

6. Intellectual Property

All platform code, design elements, branding, logos, and original content are the exclusive property of WhoCalled. Users retain ownership of their submitted comments and reports but grant WhoCalled a perpetual, worldwide, non-exclusive license to display, modify, archive, and distribute that content as necessary for platform operations.

Reverse engineering, decompiling, or attempting to extract source code from the platform is strictly prohibited.

7. Modification & Termination

WhoCalled reserves the right to modify, suspend, or terminate these Terms of Service at any time without individual notice to users. Material changes will be announced via platform notifications. Continued platform usage after changes constitute acceptance of revised Terms.

Accounts or access privileges may be terminated immediately without refund or appeal for violations of these Terms, as determined at WhoCalled's sole discretion.

8. Governing Law & Dispute Resolution

These Terms are governed by the laws of Greece without regard to conflict of law principles. Any dispute arising from these Terms or platform usage shall be resolved through binding arbitration in accordance with Greek arbitration rules, with proceedings conducted in Athens, Greece.

Users waive any right to participate in class-action lawsuits or class-wide arbitration against WhoCalled.
